By checking the "I Agree to the Terms & Conditions" checkbox at the time of purchase, I acknowledge and agree to the following, as well as the terms of the  Full Retreat Waiver, Assumption Of Risk & Release Of Liability Below.

Participant Acknowledgment & Consent

• I understand that the Barred Owl Mini Retreat includes mindfulness-based experiences such as guided meditation, gentle movement, journaling, sound experiences, group reflection, and time spent in a shared retreat setting. These activities may involve physical, emotional, or psychological experiences.
• I am participating voluntarily and understand that I am responsible for listening to my body, honoring my own limits, and choosing my level of participation at all times. I may step out of or modify any activity as needed.
• I understand that this retreat is a personal growth and mindfulness experience and is not medical care, psychotherapy, or a substitute for professional medical or mental health treatment.
• I acknowledge that participation carries inherent risks, including physical discomfort, emotional release, or unforeseen injury, and I willingly assume responsibility for my participation.
• To the fullest extent permitted by Massachusetts law, I release and hold harmless Barred Owl Retreat, Jessica Bane Robert, and Company from any claims arising from my participation, except in cases of gross negligence or willful misconduct.
• I understand that retreat payments and cancellation policies apply as described.
• I consent to photography, video, or audio recordings for educational or marketing purposes unless I notify the host in writing prior to the retreat.
• I confirm that I am at least 18 years of age.

BARRED OWL RETREAT

Full Retreat Waiver, Assumption Of Risk & Release Of Liability

This Retreat Waiver, Assumption of Risk, and Release of Liability (“Agreement”) is entered into voluntarily by the undersigned participant (“Participant”) in consideration of being permitted to participate in retreats, workshops, classes, or programs offered by Barred Owl Retreat and Jessica Bane Robert (“BOR,” “Host,” or “Company”).

I. GENERAL INFORMATION

This Agreement applies to all Barred Owl Retreat offerings, including but not limited to one-day mini retreats, retreat series, workshops, and related programming held at or hosted by Barred Owl Retreat, located at 88 Marshall Street, Leicester, Massachusetts 01524, or at any off-site location.

II. DESCRIPTION OF ACTIVITIES

I understand that Barred Owl Retreat offerings may include, but are not limited to:

• Guided meditation and mindfulness practices
• Gentle movement, stretching, or yoga-inspired practices
• Breath awareness or breath-based practices
• Sound experiences or sound journeys
• Journaling, creative or expressive reflection
• Group discussion or shared reflection
• Emotional or self-inquiry practices
• Time spent indoors and/or outdoors on retreat property
• Shared retreat spaces and facilities

III. VOLUNTARY PARTICIPATION & PERSONAL RESPONSIBILITY

I affirm that my participation is voluntary. I understand that I am solely responsible for:

• Listening to my body and inner experience
• Choosing my level of participation
• Modifying or opting out of any activity
• Communicating my needs or boundaries

I understand that I may stop or step away from any activity at any time.

IV. ACKNOWLEDGMENT OF RISK

I acknowledge that participation in retreat activities involves inherent risks, including but not limited to:

• Physical discomfort, strain, or injury
• Emotional discomfort, vulnerability, or release
• Psychological stress or the surfacing of memories or feelings
• Illness or exposure to communicable conditions
• Environmental risks (weather, terrain, shared spaces)

I understand that these risks may arise from my own actions, the actions of others, environmental conditions, or the ordinary negligence of the Host.

I knowingly and freely assume all such risks, whether known or unknown, foreseeable or unforeseeable.

V. MEDICAL & MENTAL HEALTH DISCLAIMER

I understand and agree that:

• Barred Owl Retreat offerings are not medical care, psychotherapy, or mental health treatment
• No diagnosis, treatment, or medical advice is provided
• Participation is not a substitute for professional medical, psychological, or psychiatric care

I affirm that I am physically and emotionally able to participate and have consulted a qualified healthcare provider as needed.

VI. RELEASE OF LIABILITY & WAIVER OF CLAIMS

To the fullest extent permitted by Massachusetts law, I hereby release, waive, discharge, and hold harmless Barred Owl Retreat, Jessica Bane Robert, and Company, their employees, contractors, agents, volunteers, and representatives from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or related to my participation, including claims based on ordinary negligence.

VII. INDEMNIFICATION

I agree to indemnify and hold harmless Barred Owl Retreat, Jessica Bane Robert, and Company from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from my actions, conduct, or participation that result in injury to me, others, or damage to property from my actions or any actions of the other participants and facilitators.

VIII. CONSENT TO MEDICAL TREATMENT

In the event of illness or injury, I authorize Barred Owl Retreat, Jessica Bane Robert, and company to seek emergency medical treatment on my behalf if deemed necessary. I understand that I am solely responsible for any medical costs incurred.

IX. MEDIA RELEASE

I grant Barred Owl Retreat and Jessica Bane Robert the irrevocable right to photograph, record, or otherwise capture my likeness, voice, or written words during or after the retreat.

I authorize the use of such materials for marketing, educational, or promotional purposes in any medium, without compensation. I waive any right to inspect or approve the final product and release BOR from any claims related to their use, including claims of distortion or misuse.

I may opt out of media participation by providing written notice prior to the retreat.

X. PAYMENTS, CANCELLATIONS & FORCE MAJEURE

I understand and agree to the retreat payment and cancellation policies as published at the time of registration.

Barred Owl Retreat shall not be liable for cancellations or changes due to circumstances beyond its control, including but not limited to acts of God, weather, illness, emergencies, government restrictions, or unforeseen events. In such cases, refunds or transfers will be handled as outlined in the retreat policy.

XI. GOVERNING LAW & VENUE

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. Any legal action shall be brought exclusively in a court of competent jurisdiction within Massachusetts.

XII. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

XIII. ENTIRE AGREEMENT & ELECTRONIC SIGNATURE

This Agreement constitutes the entire agreement between the parties and supersedes any prior communications or understandings.

By agreeing to the terms & conditions at checkout, I confirm that I have read, understand, and voluntarily agree to the terms of this Agreement. I acknowledge that I am giving up substantial legal rights, including the right to sue.
